This I.YOU self-coaching leadership tool (App) User Agreement (“Terms of Service”) applies to your access to and use of the website of the I.YOU project and its adjacent mobile app (collectively, the “Services”) provided under the I.YOU Project, supported by Erasmus+. (“The app,” “we,” “us,” or “our”).
Do not forget that The App is supportive and entertaining, however, one still needs to follow a few basic rules. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.
Your Access to the Services
You must be over the age needed by the laws of your country to create an account or otherwise use the Services, else we require verifiable consent from your parents or legal guardian.
If you are agreeing to these Terms on behalf of an organization or entity, you represent and warrant that you are authorized to agree to these Terms on that organization or entity’s behalf and bind them to these Terms (in which case, the references to “you” and “your” in these Terms, except for in this sentence, refer to that organization or entity).
You will only use the services for your own internal, personal, non-commercial use, and not on behalf of or for the benefit of any third party, and only in a manner that complies with all laws that apply to you. If your use of the services is prohibited by applicable laws, then you are not authorized to use the services. We cannot and will not be responsible for your using the services in a way that breaks the law.
You will not share your account or password with anyone, and you must protect the security of your account and your password. You are responsible for any activity associated with your account.
The App is Not a Replacement for Professional Support: We believe in the power of Design Thinking for solving daily challenges, however, in lots of situations this kind of help may not be appropriate and should not be used as a replacement for professional support or information from a medical professional.
Safety And Security: We undertake steps for the safety and security of the App users by removing individuals violating our Terms. We forbid misuse of our Services, harmful conduct towards others, graphic or explicit content and violations of our Terms and policies.
Enabling Worldwide Access To Our Services: To operate our global Service, we require to store and distribute content and information on servers and systems around the world, including outside your country of residence. This infrastructure may be owned or operated by our service providers.
Your Use of the Services
The app grants you a personal, non-transferable, non-exclusive, revocable, limited license to use and access the Services solely as permitted by these Terms. We reserve all rights not expressly granted to you by these Terms.
Except as permitted through the Services or as otherwise permitted by us in writing, your license does not include the right to:
- license, sell, transfer, assign, distribute, host, or otherwise commercially exploit the Services or Content;
- modify, prepare derivative works of, disassemble, decompile, or reverse engineer any part of the Services or Content; or
We reserve the right to modify, suspend, or discontinue the Services (in whole or in part) at any time, with or without notice to you. Any future release, update, or other addition to functionality of the Services will be subject to these Terms, which may be updated from time to time. You agree that we will not be liable to you or to any third party for any modification, suspension, or discontinuation of the Services or any part thereof.
Your App Account and Account Security
You are solely responsible for the information associated with your Account and anything that happens related to your Account. You must maintain the security of your Account and immediately notify us if you discover or suspect that someone has accessed your Account without your permission.
Any information or content posted or transmitted through the services, at your own risk as we cannot control and have no duty to take any action regarding how you may interpret and use the content or what actions you may take as a result of having been exposed to the content, and you hereby release us from all liability related to the content of our service.
Our services and the content provided therein are for informational and educational purposes and are not a substitute for the professional judgment and advice of healthcare professionals. The content and the services are not intended to be used for medical diagnosis or treatment. Persons accessing this information assume full responsibility for the use of the information.
The Services may contain information or text(“Content”), including Content created or submitted to the Services by you or through your Account (“Your Content”). We take no responsibility for and we do not expressly or implicitly endorse, support, or guarantee the completeness, truthfulness, accuracy, or reliability of any of Your Content.
By submitting Your Content to the Services, you represent and warrant that you have all rights, power, and authority necessary to grant the rights to Your Content contained within these Terms.
Although we have no obligation to screen, edit, or monitor Your Content, we may, in our sole discretion, delete or remove Your Content at any time and for any reason, including for violating these Terms, violating our Content Policy, or if you otherwise create or are likely to create liability for us.
Third-Party Content, Advertisements, and Promotions
The Services may contain links to third-party websites, products, or services, which may be posted by advertisers, our affiliates, our partners, or other users (“Third-Party Content”). Third-Party Content is not under our control, and we are not responsible for any third party’s websites, products, or services. Your use of Third-Party Content is at your own risk and you should make any investigation you feel necessary before proceeding with any transaction in connection with such Third-Party Content.
Things You Cannot Do
When accessing or using the App, you must comply with these Terms and all applicable laws, rules, and regulations. You represent, warrant, and agree that you will not contribute any content or user submission (each of those terms is defined below) or otherwise use the services or interact with the services in a manner that:
- Infringes or violates the intellectual property rights or any other rights of the Services;
- You will not use another person’s account to gain access to our site or our app;
- Violates any law or regulation;
- Use the Services in any manner that could interfere with, disable, disrupt, overburden, or otherwise impair the Services;
- Attempts, in any manner, to obtain the password, account, or other security information from any other user;
- Upload, transmit, or distribute to or through the Services any viruses, worms, malicious code, or other software intended to interfere with the Services, including its security-related features;
- Use the Services to violate applicable law or infringe any person’s or entity’s intellectual property rights or any other proprietary rights;
- Decompiling, reverse engineering, or other attempts to obtain the source code or underlying ideas or information of or relating to the services;
A violation of any of the foregoing is grounds for termination of your right to use or access the services. We reserve the right to remove content and/or delete your account at their discretion, in case the terms of this Agreement are violated. We encourage you to report content or conduct that you believe violates these Terms or our Content Policy.
We Do Not Provide Medical Advice
No licensed medical professional/patient relationship is created by using information and/or services provided by or through the use of the app/website or through any other communications from us. The content of the app and the services are not and should not be considered medical advice or a substitute for individual medical advice, diagnosis or treatment.
Your use of information provided on the app/website is solely at your own risk. Nothing stated or posted on the app/website or available through any services is intended to be, and must not be taken to be, the practice of medicine or the provision of medical care.
Changes to these Terms
We may make changes to these Terms from time to time. If we make changes, we will post the revised Terms and update the Effective Date above. If the changes, in our sole discretion, are material, we may also notify you by sending an email to the address associated with your Account (if you have chosen to provide an email address) or by otherwise providing notice through our Services. By continuing to access or use the Services on or after the Effective Date of the revised Terms, you agree to be bound by the revised Terms. If you do not agree to the revised Terms, you must stop accessing and using our Services before the changes become effective.
You may terminate these Terms at any time and for any reason by deleting your Account and discontinuing use of all Services. If you stop using the Services without deactivating your Account, your Account may be deactivated due to prolonged inactivity.
We may suspend or terminate your Account, moderator status, or ability to access or use the Services at any time for any or no reason, including for violating these Terms or our Content Policy.
The app also reserves the right to terminate (or suspend access to) your use of the services or your account, for any reason in our discretion, including your breach of these Terms. The app has the sole right to decide whether you are in violation of any of the restrictions set forth in these Terms.
